Government releases draft Copyright Amendment Bill

In the final weeks of 2021, the Department of Infrastructure, Transport, Regional Development and Communications released the exposure draft Copyright Amendment (Access Reform) Bill 2021. 

The Bill comprises five main reform measures:

  • Limitation on remedies for use of orphan works
  • New fair dealing exception for non-commercial quotation
  • Update and clarify library and archives exceptions
  • Update and restore education exceptions
  • Streamline the government statutory licensing scheme

There is also a review of the technological protection measure exceptions in the Copyright Regulations. 

Prior to the release of this Bill, the ASA provided feedback on the proposed copyright access reforms to the Department. We are currently reviewing the draft legislation and will share our thoughts on the proposed amendments in the coming weeks. Submissions on the draft legislation are due by 25 February.
